Litigation Funding is quite simple: your solicitor, a claim and Allianz
You know that you have a good, well-founded claim. Nevertheless, the chances of success still need to be clarified. That is the time to bring Allianz Litigation Funding on board. There’s more strength in a team of three.
For a successful three-way co-operation, we recommend you follow the steps below:
Talk to your solicitor. Provide him or her with all of the relevant information and documents necessary for a legal assessment of the matter.
Tell your solicitor that you are considering funding the proceedings with Allianz Litigation Funding. Please draw his or her attention to our website and the information contained there.
Consult with your solicitor and ask him or her to contact us for any further questions or for the request to finance.
Please Note:
Litigation funding companies and their employees do not give legal advice.
It is therefore absolutely necessary that you engage a solicitor first.
If you do not obtain legal advice, we will not be able to make a decision about financing.
Our assessment of the case is free of charge. Please note however that we do not fund investigative measures. Where after our internal assessment we decide not to fund your case, you will have to bear the costs you have incurred for any initial enquiries you have commissioned, including legal opinions, even if we requested them to undertake our own assessment.
Litigation Funding agreement
If we share your lawyer´s view of the prospects of success in the claim, we enter into a litigation funding agreement. The agreement covers the relationship between you as the claimant and Allianz Litigation Funding. Amongst other things, the agreement incorporates a budget and defines the extent of our funding and the agreed share of the proceeds which we are entitiled to should the claim succeed.
If we do not fund your case
Should we decide not to back your case, we will provide you with our reasons for our decision. These can be factual or legal. It may be a useful ´second opinion´ on your case.
