
Litigation Funding is not as complicated as some people think
After a detailed examination of your client’s documents, and taking into consideration the facts and the legal strength of the case, you have come to the conclusion that the claim has very good prospects of success.
In that case we look forward to working together with you.
In order for us to make an additional assessment of our own, we would ask you to please send us the following information and documentation:
- Your assessment of the chances of success and the associated risks of the case at hand including any relevant information on its history, if not already contained in the draft statement of claim,
- Your suggestions on how to proceed (out-of-court),
- A draft statement of claim,
- Copies of any other documents relevant to the case.
- Counsel's opinion (if possible).
- An estimate of the costs of the proceedings and the funding required.
- If your client has obtained ATE cover for adverse costs please provide details. It usually makes sense to obtain separate ATE cover for adverse costs, as the ATE premium is recoverable.
Our assessment will follow your own legal analysis or will be based on it. That is why your work and your assessment – together with Counsel's view – are so important to us.
Assessment of your funding request
Within a week you will hear from us. We may request additional information, usually by asking specific questions. If we are interested in funding we will indicate commercial terms early on. Once terms are agreed subject to contract we will send out a funding agreement and make a final funding decision within three weeks of receiving the signed funding agreement back from the claimant.
Entering into the funding agreement
The funding agreement is made between Allianz Litigation Funding and your client. It covers the terms of our funding commitment, incorporates a budget and defines our agreed share in the proceeds should the claim succeed.
During the proceedings you should inform us about any material developments in a timely manner. The funder has the same information requirements as an ´informed client´.
We regard the proceedings as a team effort. Our interests are aligned with your client´s interests i.e. to generate the best possible outcome within a short period of time.
